Terms of Service
These terms are an agreement between you and Joeckel Design & Development (“Gotcha”, “we”, “us”) for using the Gotcha app and joingotcha.com. By creating an account or using Gotcha, you agree to them. If you don’t agree, don’t use Gotcha.
1. What Gotcha is
Gotcha is a private space where verified adults share their own experiences dating people they’ve met, so others in their area can make safer choices. Women and men each have their own side, and members only see their own side.
Everything members post is that member’s own experience and opinion. It is not a statement of fact by Gotcha. We don’t investigate, confirm or endorse what members say about anyone. Treat what you read as one person’s account, and use your own judgment.
Gotcha is not a background check and not a consumer reporting agency. You may not use anything on Gotcha to decide on someone’s employment, housing, credit, insurance or any other eligibility.
2. Who can join
- You must be at least 18 and able to agree to these terms.
- You must pass a one-time ID and selfie check through our verification provider. It confirms you’re a real person, 18 or older, and which side you belong on. You may have one account.
- You may not create an account to monitor, find or retaliate against someone who was posted about, or to get around a ban.
3. Membership and billing
- Membership is $2.99 a month, billed by Apple through your Apple ID. It renews automatically until you cancel.
- Cancel any time in your iPhone’s Settings, under your Apple ID and Subscriptions, at least 24 hours before the renewal date. Access continues until the end of the paid period.
- Refunds are handled by Apple under Apple’s policies.
4. What you can post
You can share what happened to you, how it made you feel, your honest opinion, and questions for other members. Good experiences are welcome too.
You agree that everything you post is true to the best of your knowledge and is your own first-hand experience or clearly your opinion.
5. What you may not post
- False or defamatory statements. Don’t state as fact something you don’t know first-hand, such as a crime, a disease, infidelity or misconduct at work. Don’t pass along rumors or other people’s stories as true.
- Personal information. No phone numbers, addresses, workplaces, schools, last names, social media handles, email addresses or license plates, for anyone.
- Anything about a minor.
- Intimate or sexual images, or sexual content of any kind, including images shared without the person’s consent.
- Harassment. No threats, no calls for others to contact, confront, follow or “expose” someone, and no contacting someone because of something you read on Gotcha.
- Hate and degrading insults, including mocking someone’s body, looks, race, disability or sexuality.
- Content you don’t have the right to share, spam, ads or anything illegal.
6. How moderation works
Every post and reply is checked by an automated system before anyone else can see it. If it breaks these rules, it’s not published and you’re told what to change. We never rewrite your words; you decide how to change them. Members can report anything, and reported content may be hidden while a person reviews it.
We may remove any content and suspend or close any account that breaks these terms or that we believe puts someone at risk, at our discretion. Automated checks aren’t perfect, and a post being published doesn’t mean we’ve reviewed or approved it.
7. Your content and responsibility
- You keep ownership of what you post. You give Gotcha a non-exclusive, royalty-free license to host, store, display and moderate it within the app for as long as it’s on Gotcha.
- You are responsible for what you post. If someone brings a claim because of content you posted, you agree to cover Gotcha’s reasonable costs from that claim, to the extent the law allows.
- You can delete your own posts and replies at any time. When you delete your account, your sign-in details are erased and your remaining posts stay up without your name, shown as “Former member”, unless you delete them first.
8. If you’re posted about
Anyone, member or not, can ask us to review a post about them through our report page. We review every request. Reports of intimate images shared without consent are handled within 48 hours.
9. Legal requests
We may share information when we believe in good faith that the law requires it, such as a valid subpoena or court order, or to prevent serious harm. We keep as little as we can. See our Privacy Policy for exactly what we store.
10. Copyright
If you believe something on Gotcha infringes your copyright, send a notice to support@joeckel.design with the work, where it appears on Gotcha, your contact details, and a statement that you have a good-faith belief the use isn’t authorized. We remove infringing content and close the accounts of repeat infringers.
11. Your safety
Gotcha is a place to share experiences, not an emergency service. If you’re in danger, call 911. Meeting someone is always your choice and your responsibility; meet in public, tell a friend, and trust your instincts.
12. Disclaimers
Gotcha is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted, error-free or secure, or that anything posted is accurate, complete or reliable. We are not responsible for what members post or for anything that happens between people offline.
13. Limitation of liability
To the extent the law allows, Gotcha isn’t liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $50.
14. Ending your account
You can delete your account in the app at any time. We may suspend or close accounts that break these terms.
15. Changes and governing law
We may update these terms. If a change is significant, we’ll tell you in the app before it takes effect, and using Gotcha afterwards means you accept it. These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-law rules. Apple is not a party to these terms and has no responsibility for Gotcha.
